NCLAT rejects Amazon plea against CCI order

The National Company Law Appellate Tribunal on monday turned down Amazon's plea that challenge anti trust body Competition Commission of India (CCI) order striking down its 2019 deal with the Future group. It was for suppressing information while seeking regulatory approval. The Tribunal has up held to the views of the CCI that Amazon had mislead the antitrust regulator to believe through false statements and material omissions that the combination and its purpose were in the interest of amazon in the business of FCPL. The tribunal observed that amazon had made only limited disclosures regarded to Future Retail only in the realm of FRL's equity warrants held by FCPL.In 2019 Amazon buys 49% stake for 1431 crore in Future coupons. In 2020 Future Retail board approves Rs 24713 crore deal with Reliance retail. Amazon moves singapore international arbitration claiming future group violated its contract. In 2021 CCI imposes 202 crore penalty on Amazon, suspends 2019 future deal nod.In 2022 NCLAT admits plea of Amazon against CCI order . NCLAT rejects amazon plea against CCI order.
